1.Introduction
The present General Terms of Sale (hereinafter called "General Terms") regularize contractual relationships between the customers of the ultrasoundshop.biz site (hereinafter called "Customers") and the site itself, named "www.ultrasoundshop.biz" (hereinafter called "the Site" or "Ultrasoundshop").
These General Terms are the only to be enforceable and replace all other conditions, except preliminary dispensations, both expressed and written. Ultrasound may be forced to modify some of the present provisions that is why we suggest our kind customers to read carefully the General Terms every time you access our site. The order convalidation will mean the acceptance of the General Terms, without any possible petition.
Entering the site Customers accept to respect its General Terms and its detailed Use Conditions.


2. Making an Order
To make an order Customers have got 2 different possibilities:
- through Internet on the site: www.ultrasoundshop.biz 24 hours a day and 7 days a week
- by e-mail to info@ultrasoundshop.biz
Once ended the order process you will receive an e-mail to confirm the order. Maybe you will be asked some more information to convalidate definitely the purchase. That is why we ask you to indicate:
- a functioning e-mail address
- a home or office phone number.
Sorry for the inconvenience but these procedures are used to protect transactions from any possible frauds.

3. Information on Products
Images representing the products are not a part of the contractual precincts and in no case they will not be able to be considered as a responsibility of Ultrasoundshop. Technical files and products descriptions are supplied by partners and/or suppliers of Ultrasoundshop that declines any responsibility regarding the content of files and descriptions.


4. Prices
Sale prices indicated on the site are in euro and they are VAT included for Italy but they do not include any freight rate. Freight rates are always to be paid by customers to the shipment company and they will be eventually billed by the shipment company directly.
Ultrasoundshop has got the right to modifiy its prices in any moment but it commits itself to apply prices on site at the moment of the order process.


5. Availability
Customers orders are satisfied within the limits of available products.
If an ordered item is not available Ultrasoundshop commits itself to contact Customers by e-mail as soon as possible to inform them about their availability and their delivery times.
If only some of the orderered items are not available, Ultrasoundshop commits itself to ship the available products immediately and to take in charge the delivery freights regarding the other products.
Availabilities on the site are purely indicative and they do not represent in any case a contract obligation.


6. Delivery
Products purchased on-line can be delivered all over the Italian territory, islands included and abroad.
The order will be delivered at the address indicated at the moment of the order.

Delivery by courier:
This kind of delivery allows to receive the order at the address indicated on-line within 48 hours from the day of the effective shipment of the item in Italy; 24 hours more are necessary for products to be delivered on islands.
In case of ready-to-be-delivered goods, the effective product dispatch takes place on the day after the confirmation of payment. The expenses related to this kind of delivery may vary according to selected products.
Delivery times specified on our site are only approximative and they may vary. We also remind our kind customers that couriers deliver only on business days (e.g.: if an available product is dispatched on Friday morning, it will be delivered within 48/72 hours starting from Monday morning). Ultrasoundshop cannot be considered responsible of any consequences due to a possible delivery delay or lost or damage to products by the courier.
If the product is not delivered within the extimated time and if the Customer requires it,Ultrasoundshop will investigate on the causes of such a delay. During this period (around 15 days) it will not be possible to proceed to a refund or to a new order delivery.

IMPORTANT NOTE: At the moment of delivery, if the courier agrees, Customers will have the possibility to open the package to verify that the product corresponds to the order, without any damages or evident anomalies.
This check must be done at the moment of delivery. If the package has got external damages the order will have to be accepted writing "accepted with circumstantial reserve" followed by a signature on the waybill. On the contrary the eventual refund request regarding those damages will be automatically rejected.

Possible functioning defects not ascribable to transport are normally covered by the right of withdrawal. Customers will have to send an e-mail to info@ultrasoundshop.biz within 12 hours from the delivery to inform us on the topic.


What to do at the moment of delivery:
1. Check the integrity of package
2. In case of material external damages to the package due to transport, write on the waybill a definite reserve describing in detail what happened.

If the courier accepts to open the package in his presence:
3. Check that the dispatch does not have any damages or evident anomalies.
4. In case of non-conformity or evident damages, refuse the package and fill in the form of acceptancy indicating the problem.
5. Send an e-mail to the Customer Care describing what happened within 12 hours indicating the CCL number.

If the courier does not accept to open the package:
3a. In case of non-conformity, send an e-mail to the Customer Care with a description of what happened within 12 hours, indicating the number of dispatch or of waybill.

If products must be reshipped by Customers, the latter will have to send them back within 24 hours from delivery, to the following address:
Ultrasoundshop Servizio Post Vendita (Post-Sales Service), c/oDNSistemi, via R. Sanzio 18, 20090, Cesano Boscone, Milan, Italy.
Products must be sent back in the original package, with all accessories and manuals included. Shipping freights will be refunded by Ultrasoundshop to Customers in case of products damaged at delivery. In all other cases freight expenses are charged to Customers.

Ultrasoundshop informs all kind Customers that a 24-hour delay on delivery may happen if a supplementary test on Customer's bank data is needed for security reasons.


7. Safe Payments
Ultrasoundshop offers 3 different kinds of payment in Italy:
- Bank transfer
- Cash on delivery
- Financial leasing (by ING Lease Italia S.p.A.)


Bank Transfer: After receiving the order Ultrasoundshop will send you all the bank data to issue the payment.
Cash on delivery is available only in case of standard deliveries by couriers. Thanks to cash on delivery the order is paid directly to the courier at the moment of delivery, through a non-negotiable bank cheque. The maximum amount payable by this method is 1,500€.
Leasing: possibility to open a Leasing file subjected to the approval of the financial company (ING Lease Italia S.p.A.). For a complete list of documents clic here.

**For foreigner orders we only accept bank transfers**.



8.Withdrawal Right. Satisfied or Refunded
Internet sales are regulated by the Italian Law (D.Lgs. n.185, 22/05/1999) on distance contracts, that is drawn up out of commercial properties.

That law guarantees a withdrawal right, that is the possibility to give the purchased product back and to be refunded of the substained expenses.

This right is only for natural people (consumers), that means that it cannot be exercised by juridical people and by natural people operating for purposes related to their possible professional activity.

To exercise the withdrawal right it is necessary to send the items within 10 business days from the goods delivery, by filling in the return form, selecting the "Satisfied or Refunded" item.

The sending back expenses are totally charged to the Customer.

The withdrawal right totally declines when the reforwarding product is not complete, that is:

  • lack of original package
  • missing of integral parts of the products (accessories, wires, operative manuals, etc. etc.)
  • product damage for reasons different from transport.

  • Ultrasoundshop will proceed with the order transmission of the new credit regarding the cost of the merchandise within 30 business days following the customer's receipt of the merchandise.
    Ultrasoundshop will consequently reject any products not packed as well as any products for which Customers have not paid the full amount of reforwarding expenses.


    9. Send back Procedure of Products
    Ultrasoundshop will only accept products which have not been damaged and complete with all accessories and manuals, reshipped in their original package.
    Freight expenses are charged to Customers.


    10. Warranties and Post-Sales Service (new Products)
    All products sold on our site are covered by the conformity legal warranty of manufacturer and this warranty usually lasts one year, without any prejudice of other legal dispositions, starting from product delivery date.
    The reforwarding expenses regarding defective or damaged products have to be paid by Customers. Anyway in the case that the legal conformity warranty could be applied to the product, those expenses will be refunded to Customers.
    Products will have to be sent back to our Post-sales Service by courier to the following address:Ultrasoundshop, c/o DNSistemi srl, 18, R. Sanzio st., 20090 Cesano Boscone, Milan, Italy.
    No matter what the problem is, the product will have to be sent back with a copy of the invoice, the warranty voucher and the return voucher.
    ATTENTION! Warranty does not apply to repairs of damages done by external causes (e.g.: accidents, knocks, lightning, sudden voltage changes, etc, etc.) or by a customer's mistake (e.g.: use of an installation not in conformity with manufacturer's specifications, the use of the product resulting dangerous for itself, the use of the product for commercial or collective purposes, use of peripherals and/or accessories and/or products not suitable for the purchased item).
    In the case that repairs are not covered by warranty, the manufacturer will establish an estimate for the expenses.
    Warranties of products sold by Ultrasoundshop do not cover:
    - Consumable products replacing (back-up batteries, fuses, trackballs, keyboards)
    - abnormal or non-conformable use of products (customers are kindly requested to read and understand carefully the operation manuals)
    - damages caused by accessories (DVD, additional monitors, non-conformable printers, etc., etc.)
    - damages due to the intervention of a technician not authorized by Ultrasoundshop
    - damages due to a non-conformable use of products
    - damages due to external causes, such as exposition to solvents or disinfectant
    - damages reported over the warranty period
    In any case Ultrasoundshop can be considered as responsible of the possible manufacturer's refuse in the application of warranty.


    10bis. Warranty and Post-Sales Service on Refurbished Products.
    If the warranty of refurbished product is not clearly and specifically indicated in the item file, it has to be considered as lasting 30 (thirty) days from the date of delivery.
    Warranties on refurbished products sold by Ultrasoundshop do not cover:
    - Consumable products replacing (back-up batteries, fuses, trackballs, keyboards)
    - abnormal or non-conformable use of products (customers are kindly requested to read and understand carefully the operation manuals)
    - damages caused by accessories (DVD, additional monitors, non-conformable printers, etc., etc.)
    - damages due to the intervention of a technician not authorized by Ultrasoundshop
    - damages due to a non-conformable use of products
    - damages due to external causes, such as exposition to solvents or disinfectant
    - damages reported over the warranty period.

    11. Controversies and Responsibilities
    This General Terms are controlled by Italian Laws. All controversies resulting from the interpretation or the execution of these General Terms will be subjected to Milan's place of jurisdiction.

    Ultrasoundshop will not be considered liable in case of no targeting of the contract for acts of God, disturbances, or total and partial strikes of public and private mail services and/or couriers, floods, fires and/or wars. Ultrasoundshop will not be considered liable of eventual indirect damages, finacial and/or economic losses and expenses that might be caused by purchasing on the Site.

    Furthermore, Ultrasoundshop suggests its customers to archive data contained in the ordered products on external supports. Ultrasound will not be considered liable of the eventual loss of data, file, and, more in general, of damages resulting from a missed data archiving activity.

    Ultrasoundshop will not be considered liable of the consequences resulting from an improper use of products sold by the Ste.

    The impossibility to use the purchased products for material incompatibility will not be considered reason of remboursement or call for Ultrasound responsibilities.

    Some links on the site may guide Customers towards other sites. Ultrasound is not liable for the content of those sites, also if they do not respect laws.

    Even though the products on sale on the site are compatible with a professional use, Ultrasoundshop will not be liable for prejudices deriving from a professional use of those products. .

    In the cases where the responsability of Ultrasoundshop cannot be prooved, it will always restricted to the value of the order.

    Ultrasoundshop offers many different services. Among these we would like to remember:

In this way you will have the opportunity to talk to experts able to answer all your questions, give you advise and suggest you which is the best item for your needs... And if they can't help you on-line, leave your data (your e-mail is enough) and you will be recontacted in a short time by a businessman who will be surely able to answer you exhaustively.

    Furthermore by leaving your data you will have the opportunity to receive periodically our newsletters and being updated on offers, services, news.

    Installation Service: It consists of a paying service guaranteeing the installation of the item by a specialized technician of our widespread assistance network.

    Post-Selling Service : This paying service can last half a day or one full day. It depends on you and the time you have to be able to exploit thoroughly your new purchase. A qualified technician will be at your disposal for the length chosen to show you the use and the potential of the product.

    Courses: Ultrasoundshop offers the opportunity to follow paying courses on ultrasound topics. At the moment these courses (going from ultrasound phisics to obstetrics, from maintenance to 2D and 3D ultrasound scanning) are held on site but soon there will be the opportunity to follow them on-line with dedicated personnel.

    13. Comments, Critics, Communications
    All Customers' opinions sent to Ultrasoundshop are monitored and moderated by Ultrasoundshop marketing. If any of these opinions turns out to be illegal or opposed to morality (abusive advertising, libellous purposes, insults, inappropriate commentsetc.) Ultrasoundshop has got the right to refuse or modify the opinion in hand.


    14. Personal Data Protection
    All information required by Ultrasoundshop are essential for the treatment and validation of orders, invoices and warranties, The absence of these data will automatically cancel the order. The registration on the Site involves the obligation to give all real and sincere information. The communication of false data is opposed to what is established in the General Terms of the Site.

    Ultrasoundshop is authorized to collect, treat and use Customers' personal data. These data are subjected to IT treatment.

    Customers have got the right of access to their data at any time, as provided by Italian and European Laws (Article 34 of 6 January 1978 Law).At any time Customers can send a request to Ultrasoundshop to verify which and how many personal data are archived (the access is restricted to a Customer's own data). Customers' data can be modified on a simple request.

    Some e-mails with news and offers will be probably sent to Customers.
    Customers can ask for the cancellation of this service by using the link provided in the emails themselves.

    Ultrasoundshop is the only company to have the personal data of its Customers. Ultrasoundshop and its partner companies are authorized to send mails regarding well-defined commercial campaigns.Ultrasound partners are chosen for the quality of their products and services and for their professional seriousness.
